These Terms of Service govern purchases made through the HCA Eagle Shop, operated by Heritage Christian Academy (“HCA,” “we,” “us,” or “our”). By accessing the Eagle Shop or placing an order, you agree to these terms.
Products and Fulfillment
Products sold through the HCA Eagle Shop are made to order by a trusted third-party production partner. Product availability, colors, sizing, production times, and shipping options may vary.
We make reasonable efforts to display products accurately. However, colors may appear slightly different depending on your screen and the materials used during production. Minor differences that are normal to the printing process are not considered defects.
Customers are responsible for reviewing the product description, color selection, and applicable size chart before ordering.
Uniform-Approved Products
Products identified as Uniform Approved are approved for student wear under Heritage Christian Academy’s current dress-code requirements.
Dress-code requirements may be updated by the school. HCA administration retains final authority regarding whether and when an item may be worn, including special events.
Orders
Submitting an order does not guarantee acceptance. We may cancel or decline an order because of:
- Product availability
- Pricing or listing errors
- Payment authorization problems
- Suspected fraud
- Shipping restrictions
- Production or fulfillment issues
If we cancel a paid order, the affected amount will be refunded.
Because products are made to order, changes and cancellations cannot be guaranteed after an order enters production. Contact us immediately if you notice an error.
Prices, Payments, and Taxes
Prices are shown in U.S. dollars and may change without notice. The price charged will be the price displayed when the order is submitted, except in cases of an obvious listing or technical error.
Applicable sales tax and shipping charges will be shown during checkout. Payment must be successfully authorized before an order can be processed.
If an order is refunded, any applicable sales tax will also be refunded as required by North Carolina law. North Carolina General Statutes §105-164.11A
Shipping and Delivery
Customers are responsible for entering a complete and accurate shipping address. Additional shipping charges may apply when an order must be reproduced or reshipped because an incorrect or incomplete address was provided.
Delivery dates are estimates and may be affected by production times, carrier delays, weather, holidays, or other circumstances outside our control.
If an order cannot ship within the promised period—or within 30 days when no shipping period was stated—we will provide any notice, cancellation opportunity, or refund required by applicable law. North Carolina Department of Justice
Risk of loss transfers as permitted by applicable law. Customers should contact us promptly about an order that is late, damaged, or marked delivered but not received.
Returns and Refunds
All purchases are subject to the HCA Eagle Shop Return and Refund Policy, which is incorporated into these terms.
Because merchandise is made specifically for each order, returns and exchanges are unavailable for selecting the wrong size or color, ordering the wrong item, or changing your mind.
This restriction does not affect remedies available for damaged, defective, misprinted, or incorrect merchandise or any rights provided by law.
Intellectual Property
The Heritage Christian Academy name, HCA name, Eagle Shop name, school logos, eagle artwork, product designs, photographs, text, and other branded materials are owned by or licensed to Heritage Christian Academy.
They may not be copied, reproduced, modified, distributed, or used commercially without written permission from HCA.
Purchasing a product does not transfer ownership of any trademark, copyright, logo, or design.
Acceptable Use
You may not use the Eagle Shop to:
- Violate any law or regulation
- Submit fraudulent orders or payment information
- Interfere with the operation or security of the website
- Attempt unauthorized access to accounts or systems
- Copy or misuse HCA intellectual property
- Resell products commercially without written permission
Third-Party Services
The Eagle Shop relies on third parties for services such as manufacturing, payment processing, shipping, website functionality, and order fulfillment.
Those providers may process information as necessary to complete an order. Use of the Eagle Shop is also subject to our Privacy Policy and the applicable terms of those service providers.
Disclaimer and Limitation of Liability
To the extent permitted by law, the Eagle Shop and its content are provided on an “as available” basis. HCA is not responsible for indirect or consequential losses resulting from website interruptions, carrier delays, or events beyond our reasonable control.
Nothing in these terms excludes liability or consumer rights that cannot legally be excluded, including liability arising from fraud, willful misconduct, or gross negligence.
Changes to These Terms
We may revise these terms when necessary. Changes become effective when posted with a revised effective date. The terms in effect when an order is placed will generally govern that purchase.
Governing Law
These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute will be handled in a North Carolina court with proper jurisdiction unless applicable law requires otherwise.
